1 BOOKING CONDITIONS FOR SINGLE TRAVEL PRODUCT PURCHASE
When you purchase flights or accommodation or another travel product from us, which are not purchased as a pre-arranged holiday, we act only as the agent for the supplier concerned, (i.e. the airline, flight consolidator, accommodation owner, hotelier, or car hire company) and their terms and conditions apply. See below for our conditions that apply to the purchase of a package holiday arranged by us (where we act as the principle).
1.1 ALTERATION AND CANCELLATION
Alteration will be treated as cancellation. Only the person making the booking can cancel and it must be in writing. See below for the charges that apply.
1.1.1 Air Ticket Refunds
Many air tickets have no refund value whatsoever. Unless your conformation invoice informs you otherwise this will apply to your ticket(s). Air tickets that do have a refund value are subject to a minimum cancellation charge of £50 per ticket. Refunds by airlines or consolidators for part-used/return halves of tickets are always less than pro-rata and in some cases there may be no refund whatsoever. Refunds will not be paid to you until they have been received by the company from the relevant airline or consolidator. This usually takes 8-12 weeks but in some cases (e.g. lost tickets) may take considerably longer. Tickets returned more than one year from date of issue are classed as expired by the airline and generally have no refund value at all. If tickets are lost or stolen certain airlines will not issue duplicates. New tickets may then have to be purchased locally at the local fare. Even if replacement tickets are purchased certain airlines will not issue refunds for lost/stolen tickets. A delay of up to 18 months is possible before authority is received from the airline to make any refund. The company applies a further £35 per ticket administration fee over and above the cancellation charges in such cases.
1.1.2 Cancellation Generally
(Subject to the Suppliers own terms and conditions which may exceed the following percentages.) Amount of cancellation of the travel price. Between 4 and 8 weeks 50%, between 2 and 4 weeks 75%, less than 2 weeks 100%, failure to arrive at point of departure 100%. You will be notified on your confirmation invoice if different cancellation charges apply.
1.1.3 Alterations by the Company
The company makes every effort to ensure that itineraries are correct, it does not own or operate airlines and other suppliers and cannot control or prevent changes. The company therefore reserves the right to change the description of any flight and/or ground service before you book, in which case you will be told before a confirmation invoice is issued. The company will endeavour to notify all changes before departure if it is practicable to do so. No compensation is payable by the company in such cases. Should a schedule change occur to your itinerary after full balance/ticket issue, on either the outbound or return flights the relevant suppliers decision will be final.
1.1.4 Cancellation by the Company
In the unlikely event that a booking has to be cancelled a full and prompt refund will be made of all moneys paid to the company less insurance premiums. No compensation is payable.
1.1.5 Price Revision
We reserve the right to pass on any cost increase levied by the suppliers. No surcharge will apply for air tickets after we receive full payment and tickets have been issued.
2 - BOOKING CONDITIONS FOR PACKAGE HOLIDAYS ARRANGED BY US
2.1 YOUR COMMITMENT TO US
2.1.1 Booking & Payment:
To make a definite reservation, please send the e-booking form accompanied by a deposit of £100 per person in addition to the Insurance Premium (if required). Cheques should be made payable to Mina Holidays Ltd. We also accept debit and credit card payments, (Visa and Mastercard). Credit cards are subject to a 2% surcharge to cover banking fees.
If you are booking within 8 weeks of the departure date, full payment is required. Your booking is neither accepted nor is there any contract between us until you receive our Written Confirmation/Invoice. The balance due as shown on your invoice must be paid to us not later than 8 weeks (56 days) before your departure. If you fail to pay the balance by the due date mentioned above, we reserve the right to consider and treat the booking as cancelled and levy appropriate cancellation charges as detailed below.
2.1.2 Alterations by You:
If you wish to alter or amend your booking in any way once it has been confirmed by us, we shall do what we can to satisfy your requirements. An amendment fee of £40 per booking will be charged plus any appropriate additional holiday costs. Any alternations or amendments by you within 57 days of departure will be considered and treated as a cancellation of the original booking and will be subject to cancellation charges as shown in the table below.
2.1.3 Cancellation by You:
At any time, should you or any member of your party wish to cancel your booking, please notify us immediately. If we have already issued a Confirmation of Booking it is essential you indicate your intention to cancel in writing to ourselves. This instruction to cancel must be signed by the person who made the booking. We will not effect the cancellation until such a written advice is received. Any cancellation will incur a charge payable by you to compensate us for our estimated losses and expenses. These are as shown below, calculated as a percentage of the total holiday cost of the person or persons making the cancellation excluding the insurance premium.
If the cancellation reason(s) is/are covered under the terms of your insurance policy you may be able to reclaim these charges.

2.1.4 Complaints:
If you have a complaint whilst on holiday this must be brought to the attention of our local representative, agent, the Hotel management or the Cruise management as soon as possible. This will allow your complaint to be dealt with immediately. If however, your complaint is not resolved satisfactorily and you wish to pursue the matter on your return from holiday it is essential that you put your complaint in writing to us within 28 days of your return quoting your holiday reference.
2.2 OUR COMMITMENT TO YOU:
2.2.1 Conditions of Carriage:
Your booking is subject to the conditions of carriage of air or sea carriers some of which may limit or exclude liability. These conditions are often the subject of international agreement between countries.
2.2.2 Price Guarantee:
We guarantee that all prices are based on known costs and exchange rates. The price of the holiday may be varied at any time before we have accepted a booking form. After we have accepted your booking form the price of your holiday may be subject to surcharges on the following items: UK or foreign government action, currency fluctuations, aircraft fuel, airline charge, over flying charges, airport charges and increases in air fares. Even in this case we will absorb an amount equivalent to 2% of the holiday price excluding insurance premium, entry visa fees and any amendment charges. Any amount in excess of this 2% will be surcharged. If this means paying more than 10% of the holiday price you will be entitled to cancel your holiday with a full refund of all money paid except for insurance premiums and amendment charges. Should you decide to cancel because of this you must exercise your right to do so within 14 days from the issue date printed on your amendment invoice.
2.2.3 Alteration by US:
The holiday arrangements are planned many months in advance and changes can therefore occur for a variety of reasons. Many of these changes are very minor in nature and should not affect the overall enjoyment of your holiday. Where they are more significant we will do our best to advise you prior to your departure. Sometimes, a major alteration has to be made before your departure and provided it does not arise as a result of events beyond our control (see Important Note below) we will give you the options of either:
a) Accepting the revised arrangements.
b) Transferring to such other holiday as we may have available at its advertised price
c) To cancel your holiday with a full refund of all moneys paid.
Compensation will be payable on the scale shown below in accordance with the option you decide to take. A major change is considered to be: a change of Hotel or Nile Cruiser accommodation to that of a lower category and/or price, change of airport to other than Heathrow or Gatwick Airports that causes great inconvenience, change of your departure or return by more than 12 hours.

Important Note:
Compensation payments will not be made for changes caused by reason of war, threat of war, riots, civil strife, terrorist activity, strikes or other industrial disruption, natural or nuclear disasters, fire, quarantine, epidemics, weather conditions, government action at home or abroad, technical problems with transportation, changes of schedules or operational decisions by airlines, shipping or rail companies, airport or port closures, or any similar event beyond our control.
2.2.4 Our Responsibilities:
All reasonable steps have been taken to ensure that the holidays offered have been properly arranged and that suppliers of the various services included in your holiday are reputable, maintain high standards and that they conform with the laws of the country in which they are operating. Although we have no direct control over these suppliers we do accept responsibility for ensuring that your holiday is supplied to you as described and to a reasonable standard. Should any part of the holiday not be provided as advertised, we will agree appropriate compensation if this affected your holiday enjoyment, subject to Important Note above. Where any services consist of carriage by air or sea, our obligations and liabilities are limited in the manner provided by international conventions in respect of air or sea carriers.
2.2.5 Jurisdiction :
This agreement shall be governed by English law and be subject to the exclusive jurisdiction of the English courts.
